This Travelphotosworld.com Membership Agreement of Rules (the "Agreement") is a legal contract between you and Travelphotosworld.com. The Agreement governs your purchase and use of the various online website services, whether fee-based or free of charge, offered on Travelphotosworld.com website (each a "Service"). Your use of the Services is conditioned on your acceptance of this Agreement. By using any Service or by checking the acceptance box at the end of this Agreement, you accept and agree to be bound by all the terms and conditions of this Agreement. Since this is a binding legal agreement between you and Travelphotosworld.com, please print a copy of this Agreement for your records.
Membership Agreement of Rules (v.1.3 from December 27, 2006)
1) Photographs may be taken in any place in the world
2) Photographs must be registered at a minimum resolution of 800x600 pixels and in .jpg (.gif) format.
(Photos are displayed online at 470x350 with "TravelPhotosWorld.com" watermark in the left bottom corner)
Photographs may only be registered once. Similar (variations of the same photograph) or same photographs registered into different categories may be removed.
3) Parental Release: Photographs of children (when recognizable in the photograph) must have a written and signed consent by a parent or legal guardian of the child or children "on file" with TravelPhotosWorld.com before the photograph may be registered and displayed.
4) Model/Portrait Release: Photographs of adults (when recognizable in the photograph) must have a written and signed consent "on file" with TravelPhotosWorld.com before the photograph may be registered and displayed.
5) In the event that ownership of any photograph submitted to TravelPhotosWorld.com is contested in any manner, TravelPhotosWorld.com reserves the right to remove and disqualify the photograph from the member's gallery and any contests.
6) By registering your photographs with TravelPhotosWorld.com, you agree to the following:
Release by the Photographer
I certify that I am the person who took the photograph(s) submitted here (collectively, the "Photographs"), that I own the copyrights to the Photographs, and that I have the authority to enter into this Release;
I release TravelPhotosWorld.com from any liability whatsoever that arises from the use of the Photographs except for uses that violate the terms and conditions of this release. I agree to work in good faith with TravelPhotosWorld.com to promptly resolve any problems or disputes that may arise due to my registration of the Photographs.
By registering my Photographs with TravelPhotosWorld.com, I grant TravelPhotosWorld.com the royalty-free and non-exclusive right to use my Photographs as follows:
a) on the TravelPhotosWorld.com website (with a watermark);
b) in TravelPhotosWorld.com electronic emails;
c) in TravelPhotosWorld.com presentations;
d) in TravelPhotosWorld.com wallpapers and calendars;
e) in TravelPhotosWorld.com electronic postcards (if photo won in a category);
e) also TravelPhotosWorld.com can present for upload fullsize photos with author and TravelPhotosWorld.Com copyright watermark;
I further waive the right to inspect or approve the final use of my Photographs by TravelPhotosWorld.com for the above uses.
I understand that TravelPhotosWorld.com will request additional permission from me before using my Photographs for purposes other than listed above.
I understand that my Photographs will not be otherwise distributed to any third party or sponsors without my permission.
7) Members must register a photograph into one relevant category.
Our 4 Categories for registration purposes:
a) Countries
b) Cities
c) Hotels
d) Beaches
e) Shops
All categories have 2 subcategories:
a) Members Gallery - all photos related to the category
b) Information Gallery - official and commercial (promotion) photos
TravelPhotosWorld.com reserves the right to determine and change a photograph's category or subcategory.
8) We have 4 types for our users.
1. "Free user". All visitors must register FREE as "Free User" first.
"Free user" can:
a) upload 50 photos to the site (only in "Member's Gallery")
b) add 50 comments to photos at the site
2."Beginner". If you "Free user" - you can FREE upgrade account to "Beginner" (if you have 50 photos and 50 comments).
"Beginner" can:
a) upload 200 photos to the site (only in "Members Gallery")
b) add 500 comments to photos at the site
c) edit his photos information (except photos which won awards)
d) vote on countries, cities, hotels, shops and photos
3."Expert". If you "Beginner" - you can upgrade account to "Expert" ($10/year only). If you "Free user" - you can upgrade account to "Expert" ($13/year only).
"Expert" can:
a) upload 500 photos to the site (in "Members Gallery")
b) upload 100 photos to the site (in "Information Gallery")
c) add 500 comments to photos at the site
d) edit his photos information (except photos which won awards)
e) vote on countries, cities, hotels, shops and photos
3."Member". If you "Expert" - you can upgrade account to "Member" ($20/year only). If you "Beginner" - you can upgrade account to "Member" ($30/year only). If you "Free user" - you can upgrade account to "Member" ($40/year only).
"Member" can:
a) upload 1000 photos to the site (in "Members Gallery")
b) upload 500 photos to the site (in "Information Gallery")
c) add 1000 comments to photos at the site
d) edit his photos information (except photos which won awards)
e) vote on countries, cities, hotels, shops and photos
Note: TravelPhotosWorld.com reserves the right to stop a membership ahead of time if user transgressed these Rules or attempted to create obstacles in the normal working TravelPhotosWorld.com
Note: TravelPhotosWorld.com open for propositions about new type of a membership
